Affiliate Terms

1. The Program

The Program lets approved affiliates share Creator Socials using an assigned referral link, creator code, or other approved tracking method. Eligible referrals may earn the Affiliate a commission under these Terms.

Creator Socials is a planning and organization app for creators. We do not promise that the app will increase income, secure brand deals, create a particular outcome, or replace a creator’s own judgment, work, or professional advice.

2. Eligibility and Approval

You must be at least 18 years old, reside in the United States, and be legally able to enter into this agreement. Applying does not guarantee acceptance. We may accept, decline, pause, or remove an Affiliate at our discretion.

Only approved Affiliates may promote Creator Socials as part of this Program or use an assigned referral link or creator code. Acceptance into the Program does not create an employment, agency, franchise, joint-venture, or exclusive relationship between you and Creator Socials.

3. Your Link, Creator Code, and Attribution

We will give each approved Affiliate an individual referral link, creator code, or both when the applicable tracking system is available. You may share only the link, code, and approved assets assigned to you.

A referral must be properly recorded by our tracking system within 30 days of the qualifying referral action to be eligible. Referral attribution is locked to the first valid Affiliate recorded for that customer and may not be transferred later. Our tracking records control if there is a question about attribution.

Tracking can be affected by device settings, platform limits, customer behavior, technical errors, or a customer’s failure to use a link or code. We will use reasonable efforts to operate the Program fairly, but we cannot guarantee attribution where the referral was not recorded by the applicable system.

4. Commission

For each Eligible Referral, you may earn a commission equal to 20% of Eligible Net Subscription Revenue from that customer’s first six successful paid monthly Creator Socials Pro charges.

“Eligible Net Subscription Revenue” means subscription revenue actually received by Creator Socials for an Eligible Referral, after deductions for applicable taxes, App Store or payment-platform fees, refunds, chargebacks, credits, discounts, currency conversion, fraud, and other transaction-related adjustments.

“Eligible Referral” means a new, paying Creator Socials Pro customer properly attributed to you through the applicable tracking system. Eligible Referrals do not include:

• free installs, unpaid trials, refunded charges, chargebacks, or fraudulent transactions;
• your own purchases, purchases by household members, or any self-referral;
• existing Creator Socials paid subscribers;
• duplicate, manipulated, or improperly tracked referrals; or
• purchases that violate these Terms, our Terms of Service, platform rules, or applicable law.

Commissions apply to monthly Pro subscriptions only. Annual plans, if offered, are not included unless we confirm otherwise in writing.

5. Payouts

Commissions are reviewed and paid monthly after the applicable refund hold. A $10 USD payout minimum applies. If your eligible balance is below $10, it automatically carries over to the next month until it reaches the minimum.

You are responsible for providing accurate payout information and any required tax forms before payment. We may delay payment while payout details, identity information, or tax documentation is incomplete, inaccurate, or under reasonable review. Payment-provider fees, if any, will be disclosed through the applicable payout process.

We may correct, withhold, reverse, or offset commissions that were paid or credited in error, connected to a refund or chargeback, or associated with fraud, misuse, or a violation of these Terms.

6. Taxes

You are an independent contractor and are solely responsible for your own taxes, reporting, insurance, and business expenses. Before your first payout, we may require a completed Form W-9 or other documentation we reasonably need for tax or payment compliance. Where required by law, we may issue a tax form for commissions paid to you.

7. Required Disclosure

You must clearly and conspicuously disclose your affiliate relationship whenever you promote Creator Socials. The disclosure must be easy to notice and understandable in the same content where the recommendation appears; do not hide it in a block of hashtags or only on your profile.

You are responsible for following applicable advertising, endorsement, consumer-protection, and platform rules, including the rules of TikTok, Instagram, YouTube, and any other platform you use.

8. How You May Promote Creator Socials

We want you to make content in your own voice. You may use approved Creator Socials brand assets and factual product information solely to promote Creator Socials through the Program.

You may not:

• make false, misleading, unverified, or exaggerated claims about Creator Socials;
• claim or imply guaranteed income, growth, brand deals, virality, time savings, or outcomes from using the app;
• offer discounts, trials, bonuses, or special terms that Creator Socials has not approved in writing;
• run paid search ads, bid on Creator Socials or ZCreates trademark terms, register confusing domains, or impersonate Creator Socials;
• use spam, unsolicited bulk messages, fake accounts, bots, cookie stuffing, link cloaking, or deceptive redirects;
• alter another Affiliate’s link or creator code, interfere with tracking, or create referrals for yourself; or
• present yourself as an employee, agent, or authorized spokesperson of Creator Socials.

9. Your Content and Our Brand

You own the content you create. We do not obtain the right to use your name, image, likeness, voice, posts, or videos in paid advertising or other marketing unless you separately give us permission in writing.

We may ask to repost content that tags Creator Socials on our organic social channels, website, or email. We will request permission before doing so unless you have clearly granted it through the relevant platform’s feature or in writing.

All Creator Socials names, logos, designs, app screens, and supplied assets remain our property. Your permission to use them is limited, revocable, non-exclusive, non-transferable, and only for Program promotion while you remain an approved Affiliate.

10. No Complimentary Access Is Promised

Participation in the Program does not include free Creator Socials Pro access, a gifted subscription, payment for content, or any other benefit unless we specifically offer it to you in writing. We may offer optional benefits to individual Affiliates without being required to offer the same benefit to every Affiliate.

11. Suspension and Termination

You may leave the Program at any time by contacting us. We may suspend or terminate your participation at any time, including for inactivity, fraud, misleading promotion, failure to disclose, violation of platform rules, harm to Creator Socials or its community, or violation of these Terms.

After termination, you must stop using Creator Socials brand assets, referral links, and creator codes. Except where we terminate you for fraud, misconduct, or a material violation of these Terms, you remain eligible for valid commissions already properly attributed before termination through the end of the applicable six-charge commission period, subject to these Terms.

12. Changes to the Program

We may change, pause, or end the Program, including its commission structure, eligibility criteria, tracking methods, or payout process. Material changes will apply prospectively after notice. If you continue participating after a change takes effect, you agree to the updated Terms.

13. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the Program is provided “as is” and “as available.” We do not guarantee any amount of commissions, sales, conversions, app availability, tracking accuracy, or business outcome.

To the maximum extent permitted by law, ZCreates LLC and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or business opportunities arising from the Program. Our total liability for all claims relating to the Program will not exceed the total commissions paid or payable to you during the 12 months before the event giving rise to the claim, or $100 USD, whichever is greater.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless ZCreates LLC and its owners, officers, employees, contractors, and affiliates from third-party claims, damages, losses, and reasonable expenses arising from your promotion of Creator Socials, your content, your violation of these Terms, or your violation of another person’s rights.

15. Governing Law and General Terms

These Terms are governed by Florida law, without regard to conflict-of-law principles. Any dispute not required to be heard elsewhere by applicable law will be brought in the state or federal courts located in Miami-Dade County, Florida, and you and ZCreates LLC consent to their jurisdiction. Nothing in these Terms limits rights that cannot legally be waived.

These Terms, our Terms of Service, Privacy Policy, and any written program-specific agreement form the entire agreement about the Program. If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver.
