Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and ZCreates LLC ("Creator Socials," "we," "us," or "our") governing your access to and use of the Creator Socials website, mobile application, and related services (collectively, the "Service").

By creating an account, purchasing a subscription, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to create an account. If you are under the age of legal majority where you live, you represent that your parent or legal guardian has reviewed and agreed to these Terms and permitted you to use the Service.

You may not use the Service if applicable law prohibits you from doing so.

2. Your Account

You must provide accurate account information and keep your credentials secure. You are responsible for activity conducted through your account unless caused by our failure to use reasonable security measures. Notify us promptly at support@zcreates.social if you believe your account has been accessed without authorization.

You may not sell, transfer, rent, or share your account credentials. We may suspend or restrict access when reasonably necessary to protect the Service, investigate misuse, or comply with law.

3. The Service

Creator Socials provides tools for content planning, creator-workflow organization, campaign and brand-deal tracking, business-record organization, habit tracking, reflection, and related creator activities.

Creator Socials is an organizational tool. It does not provide legal, financial, tax, accounting, medical, or other professional advice. Templates, prompts, tracking tools, and organizational fields are provided for general informational and productivity purposes. You remain responsible for reviewing contracts, invoices, financial records, deadlines, legal obligations, tax obligations, and business decisions, and for consulting qualified professionals when appropriate.

We may add, modify, limit, or discontinue features. We will provide notice when required by law, but we do not guarantee that every feature will always remain available.

4. Free and Paid Features

Creator Socials may offer Free and Pro features. The features included in each level may be described within the Service and may change over time.

If paid subscriptions are offered through the Apple App Store:

  • Payment will be charged to your Apple Account when you confirm the purchase;

  • A subscription will automatically renew unless canceled according to the terms shown in the purchase flow and your Apple Account settings;

  • You can manage or cancel the subscription through your Apple Account subscription settings;

  • Prices, billing periods, free trials, introductory offers, and renewal terms will be displayed before purchase;

  • Apple processes payment and may handle eligible refund requests under Apple's policies; and

  • Deleting the Creator Socials account or application may not automatically cancel the Apple subscription.

You are responsible for canceling a subscription through the applicable platform before renewal if you do not wish to continue. We will not charge a paid subscription until a functioning purchase flow is made available and you affirmatively authorize the purchase.

5. Apple Terms

When you download Creator Socials through Apple's App Store, Apple's applicable terms and the Apple Standard End User License Agreement also apply. If these Terms conflict with mandatory Apple terms regarding the licensed application or an App Store transaction, the applicable Apple terms control to the extent of that conflict.

Apple is not responsible for providing maintenance or support for Creator Socials except as required by law. ZCreates LLC, not Apple, is responsible for addressing claims relating to Creator Socials, including product-liability, legal-compliance, consumer-protection, and intellectual-property claims. Apple and its subsidiaries are intended third-party beneficiaries of the Apple-related portions of these Terms and may enforce those provisions.

6. Your Content

"User Content" means information, text, images, documents, files, and other material you create, enter, upload, or store through the Service.

You retain ownership of your User Content. You grant ZCreates LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and transmit your User Content solely as reasonably necessary to operate, secure, maintain, and provide the Service to you and to carry out actions you request, such as generating a temporary sharing link.

This license ends when your User Content is deleted from the active Service, except to the limited extent copies remain temporarily in backups, logs, caches, or previously completed exports, or retention is required by law.

We do not claim ownership of your creative work, captions, campaigns, business documents, or other User Content.

7. Your Responsibilities

You represent and warrant that:

  • You own your User Content or have the rights and permissions needed to use and provide it;

  • Your User Content and use of the Service do not violate law, contract, confidentiality duties, privacy rights, publicity rights, or intellectual-property rights;

  • You have appropriate authority to enter business contact information or documents involving other people;

  • You will independently review important contracts, invoices, financial figures, deadlines, and business records; and

  • You will comply with applicable third-party terms when using the Service or sharing content through another platform.

8. Acceptable Use

You may not:

  • Use the Service for unlawful, fraudulent, deceptive, abusive, harassing, or harmful activity;

  • Upload malware, destructive code, or content designed to disrupt or compromise the Service;

  • Attempt to access another user's account, data, files, or private links;

  • Bypass, defeat, or manipulate subscription, entitlement, authentication, or security controls;

  • Probe, scan, scrape, reverse engineer, or interfere with the Service except where applicable law expressly permits it;

  • Use the Service to infringe intellectual-property, privacy, confidentiality, or other rights;

  • Upload information you are legally prohibited from possessing or processing;

  • Resell, sublicense, or commercially exploit access to the Service without our written authorization; or

  • Misrepresent an affiliation with ZCreates LLC or Creator Socials.

We may investigate violations and suspend or terminate access when reasonably necessary.

9. Creator Socials Intellectual Property

The Service—including its software, interface, design, branding, original templates, text, graphics, and other materials supplied by us—is owned by or licensed to ZCreates LLC and protected by applicable law. Except for the limited right to use the Service under these Terms, no rights are granted to you.

You may not copy, distribute, sell, modify, or create derivative works from Creator Socials materials except as expressly permitted by the Service or applicable law. These restrictions do not apply to your own User Content.

10. Feedback

If you voluntarily provide suggestions or feedback, you grant us permission to use that feedback without restriction or compensation, provided that we do not publicly identify you as the source without permission.

11. Third-Party Services

Creator Socials relies on third-party services, including hosting, authentication, database, file-storage, device-sharing, and App Store services. We are not responsible for third-party services outside our control. Your use of them may be subject to additional terms and privacy policies.

12. Account Deletion and Termination

You may initiate account deletion through Settings → Delete Account. Account deletion is permanent and removes active user-associated data as described in our Privacy Policy.

We may suspend or terminate access if you materially violate these Terms, use the Service unlawfully, create a security risk, fail to pay applicable charges, or if suspension is reasonably necessary to protect users or the Service. Where appropriate, we will provide notice and an opportunity to resolve the issue.

Sections that by their nature should survive termination—including ownership, disclaimers, limitations of liability, indemnification, and dispute provisions—will survive.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." ZCreates LLC disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

We do not warrant that the Service will prevent missed deadlines, preserve every file without interruption, produce business results, secure brand deals, increase income, or ensure the accuracy or legal sufficiency of contracts, invoices, financial records, templates, or user-entered information.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

14. Limitation of Liability

To the maximum extent permitted by law, ZCreates LLC and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business opportunities, goodwill, or data arising from or related to the Service.

To the maximum extent permitted by law, our aggregate liability for all claims relating to the Service will not exceed the greater of: (a) the amount you paid to ZCreates LLC for Creator Socials during the 12 months before the event giving rise to the claim; or (b) 100 U.S. dollars.

These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless ZCreates LLC and its owners, officers, employees, contractors, and affiliates from third-party claims, damages, losses, and reasonable expenses arising from your User Content, your unlawful use of the Service, or your material violation of these Terms or another person's rights.

This section does not require a consumer to indemnify us for our own unlawful conduct and applies only to the extent permitted by law.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute not required to be heard in another forum by applicable law will be brought in the state or federal courts located in Miami-Dade County, Florida, and you and ZCreates LLC consent to their jurisdiction.

Nothing in these Terms limits consumer rights that cannot be waived under applicable law.

17. Changes to These Terms

We may update these Terms to reflect changes to the Service, law, pricing, or business practices. We will post the revised Terms with an updated effective date and provide additional notice when required. If you do not agree to revised Terms, you must stop using the Service and may delete your account.

18. General Terms

These Terms, the Privacy Policy, applicable purchase terms, and Apple's applicable terms form the agreement governing the Service. If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, financing, or transfer of the Service.
